Just one day after a coalition of prominent civil rights groups made headlines with a letter urging the Biden administration to drop efforts to extradite WikiLeaks founder Julian Assange to the United States on espionage charges, the Biden administration has announced its intention to continue those efforts.

“Justice Department spokesman Marc Raimondi on Tuesday said the U.S. government will continue to challenge a British judge’s ruling last month that Assange should not be extradited to the United States because of the risk he would commit suicide,” Reuters reports.

“We continue to seek his extradition,” Raimondi said.

Assange’s arrest and subsequent charges under the Espionage Act in 2019 for what amount to standard journalistic practices which exposed US war crimes marked both a dramatic escalation in the US empire’s war on critical national security journalism and a sharp divergence from the Obama administration’s decision not to pursue such charges in this case. Biden is not just upholding Trump’s assault on press freedoms (far and away the single most egregious attack on journalism in the 45th president’s entire four years in office), he is rejecting the Obama administration’s decision not to charge Assange due to concerns that it would erode the First Amendment.

As The Washington Post reported during Barack Obama’s second term in 2013:

“The Justice Department has all but concluded it will not bring charges against WikiLeaks founder Julian Assange for publishing classified documents because government lawyers said they could not do so without also prosecuting U.S. news organizations and journalists, according to U.S. officials.”

“The problem the department has always had in investigating Julian Assange is there is no way to prosecute him for publishing information without the same theory being applied to journalists,” said former Justice Department spokesman Matthew Miller. “And if you are not going to prosecute journalists for publishing classified information, which the department is not, then there is no way to prosecute Assange.”

Nothing about this has changed. The Trump administration did not have access to any evidence that the Obama administration did not also have in 2013, it just chose to squint at the law from a different angle and legally interpret Assange’s journalistic activities as a violation of the Espionage Act. There is nothing whatsoever preventing other journalists around the world from facing the same fate under similarly dubious legal interpretations. The US Department of Justice is not going to be using other people’s personal definitions of what constitutes legitimate journalistic activity going forward, it’s going to be using its own.

Biden’s divergence from the Obama administration’s less authoritarian position on the matter should not come as much of a surprise, since he took an absurdly hard line against WikiLeaks after the first publications of the earth-shattering Manning leaks in 2010.

“I would argue it is closer to being a hi-tech terrorist than the Pentagon papers,” Biden said of Assange at the time. “But, look, this guy has done things that have damaged and put in jeopardy the lives and occupations of people in other parts of the world.”

It should also come as no surprise because, all things considered, this administration has not been much different from the previous one in terms of actual policy. The policy of regime change interventionism in Venezuela is the same. The policy of hawkishness toward China is the same. The policy of starvation sanctions against Iran is effectively the same. In a recent CNN interview Secretary of State Tony Blinken could not speak highly enough of Trump’s more incendiary foreign policy decisions like moving the US embassy to Jerusalem and recognizing the illegally occupied Golan Heights as Israeli territory.

There are far, far more similarities between the Trump administration and the Biden administration than there are differences. As is consistently the case with US presidents, the narratives are different, the campaign platforms are different, the political parties are different, but the actual policies and behaviors remain more or less the same.

None of this means we should stop fighting tooth and claw for Assange’s freedom: the fight is far from over. There is still time for the Biden administration to opt against appealing the UK court decision not to extradite, thereby leaving the entire embarrassing extradition attempt on Trump’s lap.

“The US may submit its Assange appeal filing by Friday to meet its deadline, but one would expect a serious policy decision to be made by the new Attorney General who, once confirmed, can review the incredibly weak case against Assange in full before making a determination,” a statement by the Courage Foundation reads. “Reports are circulating that an interim spokesperson says the Biden admin will continue the Assange case. The incoming DOJ, whose Attorney General is yet to be confirmed, can drop the charges against Assange at any time, including after this Friday’s appeal deadline.”

So we keep pushing. We cannot allow a corrupt and murderous globe-spanning empire to effectively outlaw inconvenient journalism around the world in the way it would by setting the legal precedent it is trying to set with the Assange case. If journalists everywhere know they can be extradited and imprisoned for publishing inconvenient facts about the US-centralized empire, they will largely refrain from doing so. And that is the whole idea.

Through WikiLeaks Julian Assange has revealed a lot of damning information about the most powerful entities on our planet, but by far the most damning revelation he provided was not a WikiLeaks release at all: it was the revelation that “free democracies” like the US and the UK will openly imprison and torture a journalist for telling the truth. This has been seen, and it cannot be unseen. We owe him a great debt for bringing such facts into the light. The least we can do is try to get him out of there now.

Snowden was lucky he got stuck in Moscow; if he had gotten to Ecuador, he would have been in a US super max or worse by now but Russia has nukes and a real leader.   13. You missed the point. The U.S. claims to be a democracy (which it is not), as it continues its increasingly slow slide toward full totalitarianism. You seem to think that’s OK. As a populace, we are supposed to stand for something higher. Instead, we become worse and worse.
    Whether or not you are correct about socialist governments is irrelevant to the discussion. But, then, your mother probably never told you that two wrongs don’t make a right. Integrity comes from within and has zero bearing on, or comparison to, what others are doing. Of course, there is no fail-safe system, so a breach could occur, but when it did, we all would concur, and that would be that.

      You see, Juliane Assange’s travails and travels did not commence in Sweden, but they may end there – there may be some Swedish authorities who need to be forced to face justice for committing crimes – serious crimes. It was there that he had a good time with some female companionship, and the the die was cast and the rest is history. Problem is, this female companionship thing has turned into a risky proposition these days, where you can be hung up or put in Belmarsh, cause you acted “out of line”. Know what I mean. Oh, let me tell, as a happily married with two daughters…..of forget it, just let me tell you – I know what I’m talking about!

  17. Caitlin, come on! What did you expect from an Obama 3.0 administration? Obama and Biden got Julian Assange in this mess. Julian’s unforgivable “crime” was the exposure of America’s heinous war crimes in occupied Iraq and Hillary Clinton’s corruption and disastrous policy at the State Department. As a critical person, you should know that it doesn’t matter whose occupying the White House. Not the guy who calls himself “President” holds the reins of power but the Deep State.
    Especially now, after the Deep State got rid of Trump through rigged and fraudulent elections, which put a corrupt and criminal into the White House.     1. Thank god someone got it. Even most journalists don’t get it. I was trained as a journalist and I get it, seems I am very alone. Today’s journalists are not real journalists because they don’t seem to investigate properly or join dots. They are basing their ideas on how life used to be or how we thought life was. Assange doesn’t only have information on war crimes but, fraud and massive, global, child crimes. Unless you investigate the secret societies that JFK spoke about and was killed for doing so, nobody gets it. I don’t call any of these people journalists anymore because they either have no clue and do not join the dots or are keeping silent and on a pay role, as it has to please their supporters. Why isn’t Caitlan joining any dots? To understand this one has to dig into the elites/Deep State driving all of this. To have had hope in the Biden Government, who is fraudulently there, when he and who he is associated with are the problem is stupid. One thing Trump confronted fake news, and you Caitlan should know that more than anyone when one has investigated the smear campaign against Assange driven by Hilary/ Obama administration. Unless one understands how members in both parties and in prominent positions have sold their souls and are complicit, you have no clue. There are far more real investigative research going on by ordinary people on the ground who have a curious and questioning mind than so-called journalists. The left has been infiltrated in most countries. Keep up with the times Caitlan, for they have changed.

  19. I have learned from a great and very kind man that Fascism is the profit system taking the gloves off. Now that the profit system is ending, our friends in Washington will be doing every fascistic thing they can get away with to stop it from dying. To me that is why Biden is worse than Obama. I am not surprised by what Biden is doing to Assange, just horribly disappointed. There are still good reasons why the fight to free Assange can succeed and I agree with Caitlin Johnstone the fight should continue unabated.

    Governments will call themselves lots of nice sounding names but they all tend to be very evil dictatorships when you look behind the curtains of ” the charade “. Mr. Assange is just another person in the long line of persons that governments oppress to keep other people in fear for their lives for ever opening their months or their thoughts with anything be praise for the owners and the masters of humanity.

I have been saying this until I am blue in the face, but my acquaintances who regard the election of Biden/Harris to be the second coming of Christ go purple with rage and call me all kinds of names and unfriend me on Facebook, etc., etc. None of them has a serious political thought in their head, none of them concern themselves with the past records of those politicians they support under the misguided rules of identity politics. And yet they feel qualified to vilify the likes of you and me for telling the truth. Oh, and Julian Assange for doing the same.

    1. It’s nothing more than a teem sport to them. Red vs Blue. Doesn’t matter who’s right or wrong. Nor does it matter that all the players are employed by the same league. “I picked this teem because it told the lies I preferred to hear” is about the extent of political acumen involved.

      1. So are we to assume that socialist governments don’t hold guns to people’s heads and force compliance with their edicts? Or that anyone who achieves authority in a socialist government is qualified for sainthood? Governments are one and only one thing. Bands of psychopaths with “true believers” in their wake, and bands of goons with guns in their service who hold guns to peoples heads and force them to comply with whatever insanity they are peddling today. They brand themselves as “capitalists” or “socialist” in order to corral the needed number of the above mentioned “true believers”. Government of any kind has never demonstrated any expertise or efficiency in anything other than killing people. Which they are indeed quite good at.

Perhaps because in addition to being rare, they likely don’ t last any longer than their benevolent dictator does, when they are replaced with a more normal malevolent one.

        2. You missed the point. The U.S. claims to be a democracy (which it is not), as it continues its increasingly slow slide toward full totalitarianism. You seem to think that’s OK. As a populace, we are supposed to stand for something higher. Instead, we become worse and worse.
          Whether or not you are correct about socialist governments is irrelevant to the discussion. But, then, your mother probably never told you that two wrongs don’t make a right. Integrity comes from within and has zero bearing on, or comparison to, what others are doing. Either one (person or government) behaves as the entity it claims to be or it is a fraud perpetrated and spread by propaganda so obvious that Stevie Wonder could see it.
          If you really believe what you said, you are part of the problem, not the solution.
