The US is again illegally bombing nations on the other side of the planet which it has invaded and occupied and branded this murderous aggression as “defensive”.

“At President Biden’s direction, U.S. military forces earlier this evening conducted defensive precision airstrikes against facilities used by Iran-backed militia groups in the Iraq-Syria border region,” reads a statement by Pentagon Press Secretary John Kirby. “The targets were selected because these facilities are utilized by Iran-backed militias that are engaged in unmanned aerial vehicle (UAV) attacks against U.S. personnel and facilities in Iraq. Specifically, the U.S. strikes targeted operational and weapons storage facilities at two locations in Syria and one location in Iraq, both of which lie close to the border between those countries.”

Even more absurd than the fact that we’re all still pretending this clearly dementia-addled president is “directing” anything is the claim that these actions were “defensive” in nature. It is not possible for occupying invaders to be acting defensively in the nations they are occupying an invading; US troops are only in Iraq by way of an illegal 2003 invasion, a bogus 2014 re-entry, and a refusal to leave at the Iraqi government’s request last year, and they are in Syria illegally and without the permission of the Syrian government. They can therefore only ever be aggressors; they cannot be acting defensively.

It’s like if you broke into your neighbor’s house to rob him, killed him when he tried to stop you, and then claimed self-defense because you consider his home your property. Only in the American exceptionalist alternate universe is this considered normal and acceptable.

The only actual defensive action that the US could legitimately take to protect troops in Iraq and Syria would be to remove US troops from Iraq and Syria.

As former US representative Justin Amash pointed out following the bombing, there is no actual legal authorization for US troops to be in Iraq or Syria in the first place. As journalist Glenn Greenwald highlighted, there is also no legal basis for bombings on the military personnel in those nations either, no matter how “Iranian-backed” they are.

“I know it’s boring to note this but Biden has no legal authorization to bomb ‘Iranian-backed’ targets in Syria and Iraq, making it illegal,” Greenwald tweeted, adding, “But Obama bombed Libya after the House voted against doing so, and few of the Sacred Rule Of Law mavens cared.”

The legal justification the Biden administration is using for this airstrike is the same bogus one it used for its airstrikes in Syria this past February: not counter-terrorism, but an extremely weird and broad interpretation of Article II of the US Constitution.

“As a matter of international law, the United States acted pursuant to its right of self-defense,” Kirby writes in the aforementioned statement. “The strikes were both necessary to address the threat and appropriately limited in scope. As a matter of domestic law, the President took this action pursuant to his Article II authority to protect U.S. personnel in Iraq.”

This claim the Executive Branch has been leaning on lately, that Article II permits unilateral acts of war on the other side of the planet without congressional approval, has come under criticism from legal scholars across the US political spectrum. As Tess Bridgeman wrote for Just Security following Biden’s February airstrikes:

“With former President Donald Trump’s term in office over, it’s time to evaluate his war powers legacy and where it leaves the Biden administration as it begins to grapple with how and when to use force abroad in the absence of congressional authorization. The picture that emerges from Trump’s war powers reporting to Congress is one of an extraordinarily broad vision of the president’s authority to use force abroad without congressional authorization, and of a willingness to exploit loopholes in reporting requirements in a way that obscures information on the use of force from the public.”

A willingness to exploit loopholes is right. But as long as acts of mass military violence serve as the glue which holds a globe-spanning empire together, death finds a way.

  5. The Congress should have been busy impeaching, removing from office and charging the last seven or eight presidents with war crimes and violating the constitution of this country. The power to declare war is expressly denied the executive and given to the legislature. Instead that legislature has chosen to be complicit with both the war crimes and the flouting of the constitution, meaning that they should have been thrown out of office and incarcerated as well. What’s the constitutional remedy for that? And, don’t tell me elections! All our elections have been fraudulent charades for most (probably all) of my 74-yr existence. Any successful coup could only be accomplished by the very maniacs we want to stop massacring innocents around the globe, i.e., the US military. Any repeat of 6 January, which was very weak tea as “insurrections” go, will only increase the powers of the tyrants even further.     I am not making light of your article and agree with you. However, as I read it, my mind went to an episode of court tv where a woman kept saying “show me the law” as they were proceeding. As if they would cite the statute she violated. It was sufficient for the court to say you are in violation. When she refused and resisted bailiffs carried her off to jail. You cite many times it is illegal but in what court. The international court has no bailiffs so they cannot enforce anything. Legal or illegal are only applicable terms if enforcement is possible. Therefore legality is moot as the thug does as he wishes and says to everyone this is ok as far as I am concerned.

    Where? In Fort Bragg? That’s where I’d punctuate with the comedic laughs…
    Although, to be fair, it must be acknowledged that Adolf Hitler set a precedent by systematically retaliating whenever the resistance attacked his positions in the countries he was occupying. I’m kinda disappointed the Oklahoma senator didn’t point that out since it would immediately have made things a lot clearer.
    Anyway congressmen are lucky there is Article II because the POTUS can twist the rhetoric into bombing without an agreement that they would feel compelled to give if asked, lest the military-industrial complex and the banks backing it withdrew the sponsoring of their great careers.
    This way, they don’t lose face and everybody’s happy :o)

Since the Defense Dept. is too busy on offense, they created Homeland Security for defense.     I like the analogy presented by Thierry Meyssan that the Global War On Terror was World War Three and the “evil empire” lost and had to agree to some terms at the recent meeting between Putin and Biden.

  25. I am just an old man, but I suspect that Israel ordered President Biden to bomb something to prove the point that Israel is still in charge. Sooner or later the Russians are going to allow Iran, Iraq, and Syria to actually go after United States troops in the Middle East. When that happens the United States will have to either go to war with everybody or get its troops out of there ASAP!!

    Things are definitely in an end-game situation. However, I think a lot of these acts, including the attempt to encircle Russia and China and massive exercises (note the recent attempt in the Black Sea) are not signs of strength, they are signs of weakness and desperation. All their regime change and economic warfare tactics have failed. This is all they have left, but the reality is that Russia unveiled their new generations of weapons. The US and NATO are generations behind, there is no tactical or strategic way in which they could win.

    But these guys really believe in the whole idea of just managing perception, trying to trip people up and getting them to psych themselves out.

    It just shows how completely incompetent and rotted out with decadence the Western oligarchy has become.

    On the other hand, the sooner we recognize the West has completely lost and is completely bankrupt, the sooner we can actually start talking about dealing with the realities and actually engaging other nations and cultures in a manner informed by an actual understanding of the history and culture of nations outside the West, and our common interests in mutual economic development, especially in the domain of science and infrastructure.

    This can’t be stated enough. These guys have lost, they need to go home. Their unipolar fantasy is over.

      1. Well of course money can be printed, in whatever quantity pleases us. Wealth cannot be. It requires an investment of time, effort and resources. It doesn’t matter if this pleases you or not, its simply a fact. The higher the money to wealth ratio, the less the money will buy. The notion that a lately developed money theory can displace several thousand years of economic fact is delusional.

        1. MMT is not a theory to be used for us. It’s for the owners/deciders/Pentagon/Empire.
          We are not supposed to talk about the free money, which can be used to make the world better for living beings.
          That’s not how power is harnessed to maintain control. Control to maintain control is power.
          That is most certainly not for us. We are harnessed by power. We are something like a resource, except when we become liabilities. What to do with liabilities is being broadly considered in “the halls of power”.

        2. Money isn’t wealth, as you say.
          But money can be used to direct resources, and taxes can be used to destroy money. So the US government could, if it chose, direct investment toward socially useful projects, without necessarily increasing the money to wealth ratio. Not that it will of course – even the most radical lawmakers seem committed to borrowing any money to be spent, thus enriching and empowering the financial sector, rather than simply spending it.

          1. Government could, if it weren’t for the fact that every single one of them are founded on the premise that it has authority to kill you if you don’t go along. Such authority does not attract the sane.

        I think it’s time to let go of all the financial wizardry. The quadrillion dollar financial derivatives bubble is the elephant in the room. Had it not been for the trillions pumped into the system starting in 2007, the majority of the Wall Street zombie banks would already have been vaporized.

        We need an orderly bankruptcy re-organization, which just means that we cut the speculative financial cancer and protect the real economy, the farmers, producers, industry, manufacturing, infrastructure etc…

        That’s what Glass-Steagall would do today, which is definitely something these guys fear, because it means the people can be saved, but only if we let all the Monopoly money go.
