How You Can Be Certain That The US Charge Against Assange Is Fraudulent

Julian Assange sits in a jail cell today after being betrayed by the Ecuadorian government and his home country of Australia. A British judge named Michael Snow has found the WikiLeaks founder guilty of violating bail conditions, inserting himself into the annals of history by labeling Assange “a narcissist who cannot get beyond his own selfish interest.” So that tells you how much of a fair and impartial legal proceeding we can expect to see from the British judicial process on this matter.

But the real reason that Assange has been surrendered by the Ecuadorian government, imprisoned by the British government, and ignored by the Australian government is not directly related to any of those governments, but to that of the United States of America. An unsealed indictment from the Trump administration’s District Court for the Eastern District of Virginia, accompanied by an extradition request, charges Assange with “conspiracy to commit computer intrusion for agreeing to break a password to a classified U.S. government computer” during Chelsea Manning’s 2010 leak of government documents exposing US war crimes.

This charge is premised on a fraudulent and manipulative distortion of reality, and you may be one hundred percent certain of it. Let me explain.

You can be absolutely certain that this charge is bogus because it isn’t based on any new information. The facts of the case have not changed, the information hasn’t changed, only the narrative has changed. In 2010 the United States opened a secret grand jury in Virginia to investigate whether Assange and WikiLeaks could be prosecuted for the publication of the Manning leaks, and then-Attorney General Eric Holder announced that the Obama administration was conducting “an active, ongoing criminal investigation” into the matter. The Trump administration has not turned up any new evidence that the Obama administration was unable to find in this active, ongoing criminal investigation (US government surveillance has surely acquired some new tricks since 2010, but time travel isn’t one of them), and indeed it does not claim to have turned up any new evidence.

“There’s a huge myth being misreported about today’s indictment of Assange,” journalist Glenn Greenwald tweeted today. “The claim that Assange tried to help Manning circumvent a password to cover her tracks isn’t new. The Obama DOJ knew about it since 2011, but chose not to prosecute him. Story on this soon.”

“Holder chose not to prosecute Assange based on the same info Trump DOJ cited,” Greenwald added.

“The weakness of the US charge against Assange is shocking,” tweeted NSA whistleblower Edward Snowden. “The allegation he tried (and failed?) to help crack a password during their world-famous reporting has been public for nearly a decade: it is the count Obama’s DOJ refused to charge, saying it endangered journalism.”

This is all information that the Obama administration had access to (journalist Tim Shorrock observed that the alleged 2010 correspondence between Assange and Manning “looks like it came straight from NSA surveillance” of the two), yet it chose not to do what the Trump administration is currently doing because it would endanger press freedoms. This means that nothing has changed since that time besides (A) the fact that there is now a more overtly tyrannical administration in place, and (B) the fact that the public has been paced into accepting the prosecution of Assange by years of establishment propaganda.

Last year, after it was revealed that the Trump administration was seeking Assange’s arrest, Greenwald wrote the following:

“The Obama DOJ – despite launching notoriously aggressive attacks on press freedoms – recognized this critical principle when it came to WikiLeaks. It spent years exploring whether it could criminally charge Assange and WikiLeaks for publishing classified information. It ultimately decided it would not do so, and could not do so, consistent with the press freedom guarantee of the First Amendment. After all, the Obama DOJ concluded, such a prosecution would pose a severe threat to press freedom because there would be no way to prosecute Assange for publishing classified documents without also prosecuting the New York Times, the Washington Post, the Guardian and others for doing exactly the same thing.”

Nothing has changed since 2010 apart from a more thoroughly propagandized populace and a more depraved US government, which means that this new charge that the Trump administration issued in December 2017 is based on nothing other than a diminished respect for press freedoms and an increased willingness to crush them. This makes it fraudulent and illegitimate, and the precedent that is being set by it should be rejected and opposed by everyone in the world who claims to support the existence of a free press which is capable of holding power to account.

So what are we left with? We’re left with the US government filing criminal charges against a journalist (and Assange is indisputably a journalist) for protecting his source and encouraging his source to obtain more material, both of which are things that journalists do all the time.

“While the indictment against Julian Assange disclosed today charges a conspiracy to commit computer crimes, the factual allegations against Mr. Assange boil down to encouraging a source to provide him information and taking efforts to protect the identity of that source,” said Assange lawyer Barry J Pollack in a statement today. “Journalists around the world should be deeply troubled by these unprecedented criminal charges.”

“There are parts of the indictment that are clearly designed to criminalize things journalists routinely do,” Greenwald told CNN. “Part of the accusation is that [Assange] encouraged Chelsea Manning to provide him with more documents than the original batch that she gave him, which is something that as a journalist I’ve done many times with my sources, that journalists do every day. They say ‘Oh thanks for this document, maybe you could get me this?’ They also say that he helped her to essentially cover her tracks by giving her advice about how to get this information without being detected. The only thing in the indictment, and it’s very vague, is a suggestion that he tried to help her circumvent a password; it didn’t seem to be successful, but it’s unclear whether that was designed to get documents or to simply help her cover her tracks. But either way it’s clearly a threat to the First Amendment, because it criminalizes core journalistic functions.”

In an article for Rolling Stone titled “Why the Assange Arrest Should Scare Reporters“, journalist Matt Taibbi writes that “The meatier parts of the indictment speak more to normal journalistic practices.”

“Reporters have extremely complicated relationships with sources, especially whistleblower types like Manning, who are often under extreme stress and emotionally vulnerable,” Taibbi writes. “At different times, you might counsel the same person both for and against disclosure. It’s proper to work through all the reasons for action in any direction, including weighing the public’s interest, the effect on the source’s conscience and mental health, and personal and professional consequences. For this reason, placing criminal penalties on a prosecutor’s interpretation of such interactions will likely put a scare into anyone involved with national security reporting going forward.”

The Espionage Act has not at this time been employed to prosecute Assange as many have speculated it might, and the computer crimes he’s been charged with carry a maximum sentence of five years. But this does not mean that further far more serious charges cannot be added once Assange is imprisoned on American soil, especially after his guilt in the Manning leaks has been made official government dogma following the conspiracy conviction.

“In my opinion this charging Assange with a lower-level crime (not espionage) is a trick that would allow the UK to extradite him to the US with ‘no threat of capital punishment’ only to have US prosecutors do what they always do: pile on charges,” tweeted Daniel McAdams of the Ron Paul Liberty Report, referring to assurances sought by the UK and Ecuador that Assange would not face the death penalty if extradited to the United States for the conspiracy charge.

Either way, this is a cataclysmic threat to press freedoms, and the time to act is now. The US government’s arbitrarily gifting itself the right to use fraudulent distortions to imprison anyone in the world who publishes facts about it will chill any attempts to do so in the future, and poses a far greater threat to press freedoms than anything we’ve seen in our lives. Anyone who sits idly by while this happens is signing over the sovereign right of every human being on this planet to hold power to account, and anyone calling themselves a journalist who does anything other than unequivocally oppose this move is confessing that they are a state propagandist. This is an intolerable plunge toward Orwellian dystopia, and is an assault on human dignity itself.

It’s time to shake the earth and refuse to let them cross this line. Enough is enough.

    The other reason this is fraudulent was summed up near the end of the post: The charge against Assange is NOT espionage; it is for “assisting with a password.”

    This is equivalent to saying a person will not be prosecuted for murder, but will be prosecuted for “felonious” possession of a handgun. Or a case where they say that they can’t find evidence that the person committed the crime of espionage, so they’ll be charged with lying to investigators. It shows that there is no evidence to support any real charge, so the prosecutor will create a lower-level charge against an intended target. Granted, the lower-level charge may be a “crime,” but it is not even close to why the target was targeted.

But people are 1. imperfect 2. free agents who make bad choices that are often morally off. People can choose to not care. Caring is knowing is caring. I can’t tell you how frustrated and demoralized I was when I was in my coffee shop home away from home the other day (in which I sit as I type this) and I exclaimed to a regular here – a young fellow and an entrepreneur – that the buggers have finally arrested Julian Assange and he responded with ‘Who’s Julian Assange?’ I said “Really?” He lamely said that he doesn’t keep up with stuff. Indeed. He doesn’t care. He cares about himself, even though he’s a good guy, like millions of others. Caring means putting your head up, and out of your own situation, and looking around to see what’s out there. Seeing is knowing. No one else around us in the shop said a thing. They don’t care either.

    Most progressives (certainly the English speaking ones I’m familiar with) hate Christianity (even though they only know mainstream Christianity), the idea of a Creator God and the Christian Bible. Fine. But I’ll mention something anyway – because Christianity is a better guide to me than all the progressives combined: Jesus Christ said that the end of this anti-God system of things (which today means the US-led Corporatocracy) would be marked by people doing normal things, but taking “no note.” Normal, relatively caring people (including people who want to be ‘seen’ as caring and good) will come to a bad end for not caring. That’s not harsh. Not caring is harsh. Not caring leads to things like terrorists States fighting a war of terror (and calling it a war on terror) against the people using other terrorists, destructive business as usual and the impoverishment of the majority of the population of the earth. True, the criminals get where they get via rule- and agreement-breaking, which decent people – who actually want law & order – don’t do. But the people don’t slow them down at all, Do they?

    What is depressing is reading the cheering by both Democrats and Republicans, including of course the wicked witch of the East – Hillary … she didn’t cackle quite as loudly as she did over the anal impalement murder of Gaddafi though. To fight this is to fight the establishment, which includes both major political parties.

    The arrest of Julian Assange is a crisis for all concerned. Caitlin has described what’s at stake very well. But in my blog post I present the thought that the oppressors of Julian Assange have a day of reckoning coming for their tyranny and perfidy. Perhaps in this world, but if not, then most certainly in the next.

    If the vitality of belief in God was not dying out in every land, we would not be witnessing the non-stop cavalcade of revolting spectacles of misconduct, shamelessness, and the casual appeals that are constantly being made in politics to what is base and ignoble in the human character. (By religion I mean the real stuff that what was actually taught by the messengers of God, such as the Buddha, Christ, Muhammad, and not the exploitative baloney narratives, interpretations, corruption and hypocrisy that have encrusted every religion.

    However, we are being weaned off this cataract of human perversity by the suffering it engenders. Caitlin is right when she says we have to find a better way, something new. Until then we are just, as the French say, ‘washing our hands and wiping them in the dirt.’

      Religion has too many lies to be accepted. Until someone comes up with evidence that gods exist, any talk of it will be considered to be rubbish by anyone who can think clearly. We all know right from wrong. Until people get out of the habit of ignoring their conscience and compromising righteousness, you’re going to have what you’ve got. A bad conscience makes people ill.     You can’t vote, march or protest your way out of this. Once attacked, you have to fight, whether that is “playing into their hands” or not. Of course they will say it is wrong for you to fight back. What else would they say, that would be the easiest way for them to win. Wat Tyler would have won if half of his faction had not gone soft because of some concessions (that were never going to be honored), and Bundy ranch could have led to the overthrow of the US government if the feds attacked. But like the king of England in 1381, the feds knew that, and backed off, and shot and arrested the leaders later.
    With merciless and thorough resolve, the “people” absolutely would win. Absolutely no mercy can be shown, because masters don’t make deals with slaves. Slaves must first and foremost understand they have no rights and no say. It is an unfortunate reality that it has to be this way, but we who are suddenly finding out we are slaves didn’t initiate this and have no control over the circumstances. We can only respond. I think western women need to admit humanity’s freedom has been undermined with feminism, and call on their menfolk to do what needs to be done. Father/husband, or big brother – it is time to choose.

    The indictment reads in part, “..in an offence begun and committed outside of the jurisdiction of any particular state or district of the united states..”.

    Outside the jurisdiction of the rogue nation sounds like they can’t institute legal action against him – a big handle to beat the extradition.

      Focusing on the technical definition of the supposed offense might not be the best route of defense, although of course everything available should be tried. However, Mr. Assange can reasonably argue that it was his moral and legal duty to try to prevent or impede the commission of much greater crimes, to wit, the violently criminal behavior of the US government and its ruling class, which has resulted in the deaths of millions of innocent and harmless persons in the last fifty or sixty years, along with countless other kinds of damage and destruction. These are not accusations resulting from interpretation; the actions are explicit, undeniable, material facts, which Mr. Assange’s persecutors, jailers and judges should not be permitted to forget.

        The question for someone claiming jurisdiction is to ask them how they obtained it. The answer would have be the Constitution or the “laws” that result from it. The next question is “do you have any evidence that the Constitution and it’s laws apply to anyone”? That evidence does not exist.
        Some might argue that an “oath to defend the Constitution” means that it applies to the oath giver. Nope, all it means is that someone made a promise to someone. If the promise is in writing it means something (meeting of the minds) to the signers of the contract exclusively. If there is no contract is completely meaningless.

    I posted this at the OG but I want to post it here as well cause I’m feeling your sad heart tonight Caitlin…

    Can’t sleep this night, tossing and turning, the vision of Julian Assange being dragged out of that Ecuadorian embassy seared into my brain. My stomach on fire with disgust for what that P-O-S war empire with the stars and stripes flag is doing to Venezuela and around the world – stealing, sabotaging, threatening, murdering and lying, lying, lying to us all. The collaboration and complicity of my Canadian government – the descent of my once loved CBC into a propaganda rag. Yea, I made the mistake of reading a few dozen comments below their Assange arrest article which was minimizing to say the least and those comments – a propagandized mob with no empathy like the mobs that cheered at executions in the old days. The mint tea is just not doing it for me tonight – I need something stronger but I quit drinking cause that’s what the empire wants us to do – to numb out on booze, narcotics, tranquilizers, entertainment and whatever so we don’t care what they do in our name. I won’t give them the satisfaction. I’ll stay clear-eyed and awake with Julian tonight and be damned to the war-mongers of the world, to their MSM collaborators and to those who sell their humanity away for a few pieces of silver.

    Think about that: Ecuador traded a LOAN from IMF, which the entire Ecuadorian people will be indebted to for decades to come while the country’s resources have been collateralized FOR THE BANKS’ BENEFIT, and threw in Julian Assange as a bonus.

    Do you see how that works? An existing life has served as a bargaining chip for… A LOAN, repayable by the people WITH INTEREST!!! If it is not using humans as a collateral, I don’t know what is.

    How about tugging Julian into a cell in one of USA’s foreign prisons for militants and terrorists (Ecuador or Israel maybe?) including official US democratic water boarding or spoiling behind the scenes and before a sex change free of charge (to stop further rape accusations in the future) while organising a well paid job for him/her in the controlled alternative opposition after his/her pardoned and early release – just to show the rest of the world that justice still counts, history repeats itself constantly and that only femdom and demockery matters while everything else stays the same and political correct.
    No offense intended even while constantly being offended looking at an insane and corrupt political world without any change and on a daily basis.

    With such a trivial and minor charge in the extradition request, it will prove the UK government’s complicity if it allows the extradition, and will also confirm the likelihood of more serious charges once he is on US soil.

    Technically, such a minor charge would not be sufficient to justify an extradition, but we already know that the UK is willing to allow extradition for relatively minor matters since it did nothing to resist the Swedish attempts to extradite him merely for questioning – even when there was no charge, as such.

    This whole insane situation is an example of several lawless governments in action, going from Brit coppers going onto Ecuadoran soil to effect an arrest for England, aka the USA, all the way to having no involved government abiding by international law. This is how israel operates, and we know that israel controls US government activities, but England, Ecuador, and Australia? Really?

    And, of course, everyone is aware of how this outlaw arrest and expected conviction of a journalist will effect some other journalists. I suspect that any government involved in this criminal conspiracy to destroy truth and the freedom of the press should be simply shut down for good.

    If there is no semblance of justice in government, then why have government at all?

    The whole miasma shows very clearly how far the US has fallen from being the defender of democracy and truth to the desperate destroyer of both. Unfortunately for Assange, he will meet with the full fury of a depraved state and suffer the consequences of telling the truth. Certainly the US and its tottering empire is in its death throes, but it still has the ability to spew horror to its ultimate degree. Expect that and hunker down, until the Angels of God conquer the demons of the devil. You know who I mean!

    Mr Assange was perhaps the only true journalist left out there. If Ms. Maddow and her constituents consider themselves journalists, then perhaps Assange is not a journalist. Though what seems more accurate would be to acknowledge the opposite: Mr Assange is a journalist, yet Ms Maddow and her constituents are not.

    The USG has deteriorated into blatent tyranny so quickly, outrage will need some time to catch up….though I doubt justice ever will.

        Any public revealing of just how sinister and corrupt the United States government actually is gives me hope that someday it will implode on itself and crumble!! What Mr. Assange and other whistleblowers have done takes courage beyond belief!! Very few human beings risk their very lives for their principles, their morals, or their convictions!!
